Who says you have to stick to your business plan to the letter?
After being convicted for illegal music downloading through their p2p torrent setup, the Pirate Bay, synonymous with music pirating on a global scale, took to set up a political party in Sweden. It later won a seat in the European Government election in May 2009 by garnering popular votes from the younger generations. Not only that, it hopes to spread its philosophy throughout Europe and even beyond. Although it officially shuttled down its servers after the court conviction, Pirate Bay still believes that its technology is useful. It has sold its setup to another company by the name of Global Gaming Factory X AB. And it has a new business plan as well.
It is believed that the new company will use the technology for Internet Service Providers (ISP) to reduce their data traffic. It works by spreading the ISP’s load among the many other connected servers that is used for heavy down loadings. Basically, those computers that are downloading the data will also themselves act like the ISP in helping others for downloading purposes. This way, the load on the original server (ISP) is spread out among the many other computers. When more computers are connected to the network, the speed of downloading the material becomes even faster. It is Torrent technology used in a legitimate way. Besides, the Pirate Bay will also institute a new business plan to legitimize its sale of music.

Can we patent business ideas?
Ever since the Bilski case ruling by the United States Courts of Appeal (CAFC), the question of ideas being allowed to be patented has taken greater attention from all corners. What the decision amounts to has got far reaching repercussions, getting right into the heart of any nation that has allowed for ideas to get patent protection. Perhaps it was a strategic decision for the US when computer programs were allowed to be patented in the early days of digitalization. Being the pioneer of computer systems in the world then, and later the internet highway, the US strategically garnered for itself control of information technologies by way of allowing for the patenting of ideas. It did staff off competition from others and that had in effect brought in billion of dollars in revenue for the state. Had it been otherwise, information technology would have been very different from that which we know of now.
With the Bilski decision, everything could change, maybe for the better. The implication of that decision means that you cannot patent just a mere idea, and by inference, all those holding software patents must treat it as a mere piece of waste paper without any legal clout. It must be pointed out that only the US allows patenting of ideas and the rest of the world doesn’t. If all those patents become void, the big loser will be the US companies. And in a not too surprising altercation, Red Hat, the champion of free source code programs, called on the Supreme Court of the United States to dis-allow idea patenting by way of an amicus curiae filing. Proponents of free source code software had been calling for the abolishment of patent grants to business ideas, underscoring that patents do stifle innovations. One of the reasons why the US patent office is bogged down by the large amount of filings is because it had to devote time to studying spurious business idea patents. If the US makes the decision that business ideas cannot be granted a patent, then the US patent office will be able to breathe fresh air, benefited by walking with the rest of the world!

ELINOR OSTROM, the 2009 Nobel Prize winner for economics, is a staunch believer of disallowing patent granting for business models. Together with other renowned dignitaries like Eric Maskin and Joseph Stiglizt, they formed a core of people who opposes the USPTO for granting patent rights to spurious methods of doing business. Why does economist generally oppose business method patents? For one, it opens up a can of worms like what we see now with every Tom, Dick and Harry looking at each other and bringing each other to court for patent infringements. For another, the cost involved with litigations has not only gone sky high and absolutely wasteful, but also have given patent trolls a field day, at the expense of public money. There is reason to believe that business patents have bogged down the patent office with a bag log of 700,000 cases.
