Now you have developed a Candy Crush game!
Oh, you have been playing the Candy Crush Saga game and since you are so addicted by it that you have also developed something similar but you are not sure what to name it?
Just before you follow suit, do a rethink because someone else have just beaten you to the trademark! Yes, the developer of the original Candy Crush Saga, Candy Crush Saga Studio, owned by King.com have already got a trademark for it from USPTO. Filed in February 2013, "Candy" is a registered trademark now so if you are thinking of using it, please desist as you will be sued.
The mark is filed under two categories, videogames and clothings so if you still adore the word, perhaps you can file it under other categories. Still, there is no assurance that you won't be taken to court because it could be argued that you are diminishing the value of the trademark! Already, Candy Crush Saga Studio has effected court action to several parties so it is just too late if you are going ahead to use the trademark. Maybe in other countries then but you will need to be fast about it!
As of February 24, 2014, King Corporation has filed for 'abandonment of trademark' with the USPTO but still maintains its EU filings. Time will tell whether it would maintain its European trademark but there has been a lot of backlash and adverse public goodwill since it was granted with the trademark.
